Recognising the need for judicial consistency in dealing with pleas relating to right to liberty of accused persons, SC Monday issued a judicial advisory to all HCs to post bail pleas of all accused in a criminal case before the same judge as far as possible. It said posting bail pleas of persons accused in the same crime before different HC judges results in dissimilar consideration of the facts and circumstances of the case leading to some accused getting the benefit of bail while it being denied to others.”This will create an anomalous situation,” it said.
